Just to clarify a few things for you...
As you are claiming as the "Third Party" in the claim - the other persons insurance company can not claim your vehicle as a total loss and keep the wreck. The way they will do it is as follows..
a - assess the damge - ensure the quote is fair and reasonable and that the damage to your car is consistant with the damge on the other car (ie, you are not trying to claim old repairs that are rusty or hit a pole etc)
b - work out the PAV (Prior Accident Value) of the vehicle
c - determine if the cost of repairs exceeds the PAV, if so, they pay you out the PAV less the salvage value of the car, if the cost of repairs is less than the PAV by a certain percentage - normally within 75-85%, then they pay you out the F&R (Fair and Reasonable) amount for the repairs...
so what this means is as follows..
- firstly you need to make your car look as clean and tidy, polished and vacuumed as possible - you need to make your car look at the very best it has ever looked - (except for the damage of course) - this will assist in getting your PAV to be as high as possible, so they do not prematurley write your car off. - things like - one owner, low kilometres, full service history, excellent condition etc all help in doing this.
- secondly, when the assessor F&R's your car (assuming it's not a total loss)- chances are you will not get the full amount that the repairer quoted - but, it is the assessors responsibility to ensure that what ever value they pay you, the vehicle repairer must agree to repair it for that amount.
