depends on the cars age and the ADR's it is meant to comply with.
if it has emissions ADRs, as johnny said, you have to prove it is ok. if you are meant to have a cat, it better be there, if it's loud, you have to prove it is quiet enough.
what car is it?
maybe go talk to an engineer about it, and see if what he has must be certified, or if it is not legal. best way to find out 
oh, and driving nicely also reduces defects by a drastic %
