The tvis stays closed/partly closed till a certain rpm (around 4500rpm) to improve low rpm torque, then it opens,
The vacumm is there to open them, not keep them closed.
Start the car, let it warm, the give it some curry, you will here the engine note change when the tvis opens, or just look under the hood and rev the motor from the throttle body, look under the manifold and you will see the rod move, if the rod isnt visable stick your hand up there.
If the tvis wasnt working properly the car would find it hard to rev higher in the rev range.
