Is the gearbox on the floor or is it in the car? if it hasn't got any oil in it and it's out of the car and not being used, then yes, it could be an oil issue,
but
if it's in the car and your using it and it pops out that easy, it's obviously because it's not engaging properly.. why would that be? well, could be broken teeth I suppose, or maybe the gates a knackered? I'm just guessing though. I would doubt though that the oil level in it would make any difference to how it sticks in 5th.
