I am not sure about the WA regualtions. But I was told by an engineer once that the open air-filter issue is due to the increased induction noise that the engine makes in the absence of an airbox/resonator arrangement. You might just be better off asking an engineer what the go is (with respect to the relevant ADRs that apply to your car).
