ok here is the result and my story:
I installed the Front whiteline adj swaybar, and a brake place refused to install new brake hoses because they were worried the swaybar would foul them, they also noted that the tyres rub the swaybar at full lock.
I rang whiteline and they said to return the bar to them, they investigated and found mine was current spec, so they gave me the option of having the same one sent back or to change it for a fixed swaybar which uses the original mounts and isnt as chunky as the adj one, so i got a fixed one as the adj one obviously wasnt working with my car.
He said they sell this design adj swaybar all over the world and havent had any issues, so if you too are having issues please contact whiteline at Head Office and they should help you out, their service was fantastic and im a happy customer even though i now have a fixed item, i dont care i wasnt going to be adj here and there anyway 
*edit, so in the end no exact reason to why i was having fouling problems, maybe something just might be amiss in the front end.
