Steve-AE86,
what about the comments in crab-86's member's rides thread? Raceflow clearly states that you are working for him, thus placing the URL is clearly commercial advertising. This is your warning regarding commercial advertising.
Furthermore, one more comment about "the nazi's" and you WILL be banned. Your attitude towards the people who provide you this forum for no cost is pretty pathetic to say the least.
Jon (Raceflow),
the board will respond to you in due course. Until then, i request that you please remove the URL's advertising your business from your signature as has been requested previously, and wait until a response is made.
Thank you.

The ban on your original account stands, as you were banned for legitmate reasons. Likewise your members ride thread, which was more of an advertisement for your business than it was an enthusiast sharing his joy with fellow enthusiasts.
Until such time that the board as a whole decides that your members ride thread should be reinstated, it shall remain deleted - and your old account banned.

Can I just add to this that Steve was not working for me, nor had the option of such even existed at the time he posted the offending in his signature, the employment is only as recent as the last day or so.
So please dont crucify Steve on my Behalf

Jon you were given options for sponsorship. You were given the same options as our other sponsors, you could either pay the annual fee to sponsor and advertise on the forum like all of the other forum sponsors do, or you could be a discount sponsor and list on the sponsors page.
We will not reduce the value of the investment our other sponsor have already made by giving you the same service at a reduced price.
You have specified both to me and in your posting on the forum that paying the standard rate to sponsor the Toymods Forum is not financially viable for you as you do not get enough sales from the advertising. I accept this as it is your business to run as you see fit. Having said this however I cannot see how, if advertising on the Toymods forum is worth so very little to you, you feel the need to continue to advertise here.
As to your freedom of speach and restriction of trade. There is no mandated freedom of speach in Australia, that is an American concept. The Toymods forum classifieds are for personal sales only, commercial traders are not allowed to advertise unless they are forum sponsors. We have specified this to you on several times and you have made the concious decision not to follow our rules.
At the end of the day this is the Toymods Forums, not the raceflow web site. You can do whatever you want on your website, but if you are going to use the Toymods Forum you are going to have to follow the rules of the forum.
The rules that you agreed to follow when you signed up for this forum are:
Registration to this forum is free! We do insist that you abide by the rules and policies detailed below. If you agree to the terms, please press the Agree button at the end of the page.
- This is a private forum run by the Toymods Car Club Board and membership is at their discretion.
- Users are only allowed one username.
- No Animated gifs or offensive pictures are allowed as avatars
- Personal attacks are not permitted.
- Posts that are rude, offensive, insulting, slanderous or encouraging illegal activities are not permitted.
- Political, Religious, Racist or Sexist comments or threads are not permitted.
- No pornographic content or links are permitted.
- If a member posts such comments their membership may be revoked.
- If you are moderated and you wish to discuss it then e-mail a moderator or email the board at board@toymods.org.au
- If you have concerns about any posts or threads then e-mail a moderator, select the Report message to a Moderator option or email the board at board@toymods.org.au
- The Toymods Board reserves the right to modify these rules when necessary.
TOYMODS CAR CLUB BOARD
All posts are the property and responsibility of the poster, the forum moderators and administrators have no obligation to monitor any posts, however Toymods reserves the right to edit, refuse to post or to remove any information and/or materials (in whole or in part) that in its discretion considers objectionable or in violation of any applicable law or the Conditions of Use.
As you see you have agreed that Toymods reserves the right to edit, refuse to post or remove any information and/or materials.
You have also agreed that you will only have one logon, although I see you have created a further two logons for your business.
Jon at this stage after discussion with the rest of the Toymods Board, based on the way you have conducted yourself on our forum, we are not in a position where we would be comfortable to accept you as a sponsor. We will not at this time ban your Raceflow users even though you have continued to show no regard for the rules of this forum and the contract you enterred into by joining the forum. However you will not be permitted to make posts trying to sell things or advertise your business concerns.

Josh
Thank you for taking the time to post the reply.
Your responce if hard but fair, I appreciate you allowing me to keep contact on the forum with the current sign in.
I do how ever feel that the punishment is much harsher than the crime, in that I am not able to become a sponsor of the forum based on the way I have conducted myself, I would like to say in my defence, that my conduct when compared to one of the PM I recieved from a representative of Toymods aimed at me personally, I have said or done nothing as wrong as that PM.
But enough of that.
I would then request that if you have come down on me as hard as you have over what many would see as a minor indescression, that you remain consistent and all those that are doing the same recieve the same repremand as I have, I will be only to happy to bring these offenders to your attention in my daily observations.
Is there allowance with in the current situation for a review on the decision in, say, two months and then in a further 2 months to see if the board is then comfortable to enough with me to reapply for sponsorship.
And lastly I am recieving large amounts of emails wanting updates on the Sprinter, am I able to post basic images as I did in the repost yesterday where there was no reference to Raceflo of any products what so ever, and keep it strictly that way.
Regards
Jon Roberts

Jon the reason why we don't feel we could take you on as a sponsor isn't really because of your actions under this user account it is due to your continued commercial advertising and ignoring of the boards requests for you to change your ways. Having said that the next board of the club may be of a different opinion so feel free to get back in touch with the board after the next AGM to see if the situation is changed.
Our aim is to have this forum providing a service to the club members and as an extension of that to general Toyota Enthusiasts. We do not want our forum to be exploited as free advertising for business's who want to cash in on a large community that is based around one rally point. This is the reason why we do not allow commercial advertising except by sponsors, these sponsors show a commitment to assist our members in this case by financially contributing to the future of the club.
We do not want any commercial sales on our forums other than from sponsors. Feel free to report any commercial sales by using the report post button, this is how your post were bought to our attention originally.
You can have a members rides thread that is fine. If it becomes an ad for your business though that is a different matter.

Wow!
I am serious when I say, that now you have put it in that light it makes a huge difference, and it helps me understand the reason that the Admin have been so upset.
So firstly sorry to all I have offended in my actions, secondly I have taken the purpose of the site the wrong way and have not given back to my fellow Toyota devotees as much as I have taken from them, so again sorry.
As I said in my PM to Wiltz, it is so hard to understand where some one is comming from in a one dimensional arena such as a forum, and why I made the recomendation for you to contact the businesses I deal with in the Sydney area.
Those who know me, know that i do everything 100% and to the limit, I guess I have been no different on here, but wrongly so, I appreciate the abitlity to be able to use the forum and thank you for allowing me to do so.
I would like to post up my ride, exactly as that, my ride, and am only to happy to offer advice, experiance and assistance to all who may need it.
Regards
Jon Roberts

Jon,
As Josh said - feel free to post up your ride in the member's ride section, but please be aware that it is very easy to cross the fine line between showing off your pride and joy and advertising your business.... please keep this in mind when posting.
Thank you.

2 notes for the board to consider
we have in our legal system something similar to freedom of speech in our cosntitution and set laws alas it would be a dictatorship not a democracy we live under
also, no person corporation body etc is able to deny limit or restrict etc in any way a persons legal rights and responsibilites regardless of their rule regulations conditions etc beyond that of the australian legal law so for the sake of all i hope the current setup for this website has been reviewed legally wise as it woudl be a shame to loose this site
*australia is the second highest in averages for litigation in the world btw*

isn't the forum something set up and run by ndividuals, not a business?
it would be an utter shame to see some fuckwit take toymods to court due to their inability to put up advertising, and have the forum taken down...
i think there would be a few hundred people willing to picket/firebomb said establishment....
the toymods forum is not a market. it's a place for ppl to talk abotu toyotas and sell shit they don't need.. any company that is allowed to sell things commercially should realise it is a priveledge.
companies do NOT have the right to advertie in your home (unless it is on TV or in a newspaper etc).
regardless of what ppl may think, they do not have the right to advertise anywhere and everywhere.... you cannot put stickers on ppls cars without permission, you can't put ads on telegraph poles....
freedom of speech, and freedom to advertise are completely different things.. australia doesn't have freedom of speech. no you can't make conditions that contravene aussie law, but it would be interesting to see what australian law says (if anything) about companies advertising on private forums (this is not a public forum since you have to sign up to get into it).
and as stated before, the amount of ill-will produced would likely be devastating for a business....

Thank you for your concearn with regards to this issue, But the issue has been resolved, and the out come a mutually benificial one, your coments on the issue will only cause it to become inflamed again, an outcome I do not particually wish to have happen , so thank you again for your interest, but can we let this ride.
It might be worth while if the site Admin delete the thread or lock it to avoid it flaring again.
