Exactly what I was about to post. Look at the shape of the dorsal fin. Shark fins are generally much more angular. This one is quite curved.

it seems to be horizontal
sharks dont come out with horizontal tails from factory do they ?

Take it from someone who's seen tigers and hammerheads close up. It's a shark (though neither of those). Mind you if it's a dolphin, I still wouldn't want to get too close either. Trainers get damaged by much smaller ones in their pools. Imaging what one this size could do "playing".

I speak from no experience with sharks and dolphins except for national geographic channel. The dorsal fin looks to pointed, the tail looks horizontal, though its hard to tell, could also be smudged in the picture to make it look more like a shark and the nose looks like it comes to too much of a long point as apposed to the short point of a shark.
Though do dolphins normally grow that big?

Yeah, the dorsal fin looks like a sharks, but the underwater part looks more like a dolphin, although it's kinda hard to tell.
Personaly I could easily modify the fin of a Dolphin to look like a sharks fin like this. I'm not saying that this has been modified though, I can't tell 'cuz the quality isn't so good.

That took me about two minutes to do.

As Stu said. A Dolphins 'tail' is level with the horizon ! A sharks tail is Vertical ! Case solved.
ps. someone show me a dolphin with a nose that fricken pointy. Sharks have sensitive noses and under bellies, the former due to the pointy nature. with such a point any force means great pressure which tends to hurt. Dolphins however have strong noses which they use to stab and kill kill kill the fricken sharks !.

Sorry T APLUS, that solves nothing. That tail could be vertical or horizontal. Due to distortion in the water and shadows etc, its impossible to tell for sure.
However, the nose does look kinda shark like.

Your all wrong Sharks tails and dorsals completely change shape depending on how salty the water is and also the temperature of the water.
Any shark expert will tell you that the tail and dorsal cannot be used to tell shark from a floating turd.
And its a shark! Look how long and sharp the head is.

The only people who are "OWN3D" are those folk that said it was a shark.
Here is a website created by the person (Kurt Jones) who took the photo. He has some extra shots which clearly demonstrate it is a small cetacean.
