WTF!! insurance want to write off my car!

my car was reversed into back in november by some bloke, he finally made a claim and i have finally had my car assesed today the quote was for a little over $1000 worth of damage and the assessor wants to write off my car WTF!
i almost hit the roof when i was told this
does anyone know if i agree for them to write off my car can i still register it?
this is just another kick in the teeth for me, i have been rooted around for the past few months while the guy who smashed my car is able to go about his business with no obligation as if nothing happened.

No you can't register it coz the insurance company will take your car to try and recover some of the loss.
You will be paid whatever they decide your car is worth. If you want your car back from them, you can purchase it at the auctions, Or you could just tell em to get stuffed and pay for the fix yourself. Sometimes, if your luck they will bend the rules (very rare).

Get more quotes, as I think its the actual smash repairs that say "its a write-off as its not worth fixing"
My little bro got his sprinter fixed when it was badly damaged and someone said it was a write-off straight away, he went somewhere else and they fixed it.

thanks Pete, i just got off the phone with the guy who assesed my car and he reckons he didnt say anything about writing it off, the smash repairer (whom my family knows well) either has its wires crossed or they are playing silly buggers.
none-the-less i will wait for the insurance company to get back to me
interesting what you say soaringmik, both the assessor and the smash repairer said that if it was a write off that i would be able to keep my car.

If its written off, the insurance company takes it.
Don't get it written off. If you want to do something like change the colour or get a respray over the whole car, negotiate with the smash repairs asking how much CA$H you can add in to get a full respray.

yeah, but sometimes they don't bother auctioning older cars (no offence), it's up to the insurance assesors really.. and they try to recover the cost from the responsible party. Because afterall it is his/her fault for the accident. They should pay. And they do for about the next 8 years.

Who's insurance company are you dealing with, yours or his? Also, am I right in assuming you only have 3PP insurance?
A friend of mine was recently in the same situation as you, and the at fault party's insurance company wanted to class his car as a write-off. They paid him out the (perceived) value of the car, however he was also able to keep the car which he then sold and came out a little bit ahead.
It may come down to your own insurance policy though.. I know Shannons used to offer salvage rights of the vehicle to the owner, but I can't remember if this was only for Comprehensive policies or not...
Either way best of luck, and I hope you get to keep your car.. It really does show the hard work that's gone into it...

thanks for the advice guys
its the other guys insurance company thats going to be paying (hopefully), if they do want to write it off i will make sure i either get to keep the car and be able to register it again, or i will re-negotiate repair price.

yea you will definately get to keep your car.
theres got to be something in the insurance company code of practice that would allow you to keep your salvage rights.
if your lucky (i was) i got quoted $1200 to replace one guard! (plus new tyre, wheel alignment bla bla bla) went to a prestige place. got paid out in CASH by the insurance company! got it fixed for 300 somewhere else and bought some mx5 seats...

Yeah my car was written off not that long ago. Before it was painted & everything, some young dude reversed into me, & didn't really do too much damage, but the quote was for over 4 grand (I think he got all parts prices from Toyota or something, $444 for a new grille!) & the other dudes insurance co only valued the car at 2500.
So they gave me 2300 & I kept the car.
The whole time I kept driving my car around, there was no chance the insurance co would take it off me.

if the cost of repairing is more than a full payout to you, minus the price they could get for the car at auction, they'll try and write it off.
simple maths.
that's why it's GREAT to go through someone like shannons, who are one of the few insurance companies who give you full salvage rights on a written off car (jeez I sound like a shannons sales rep sometimes, but I've had and heard nothing but good about them)
my major gripe is they wont insure under 25 engine transplanted turbocharged sports cars (which is unfortunately the category I fall in)

Insurance want to write it off because its cheaper for them,
If you agree to it being "Written off" be very careful, you have too kinds
NB These laws were in QLD to try and stop all "rebirthed" cars from making it back on the road.
"Repairable write off" this kind means the cars vin has been listed as a repairable write off and you'll need it inspected after its repaired, before it can be re-registered.
"Statutory Write off" The car's VIN number is cancelled and it is only allowed to be used for wrecking or dismantling.
I guess if you're not happy you could take the insurance company to small claims court, using the argument, it wasn't your fault and yet they won't repair the damage their client made.
