man seriously, they cant take your shit and give it to other people to use.. they HAVE to fix any damage tehy do for nothing, because it wasnt your fault.. and if they fuck your car up.. they need to replace everything they break..

I strongly recommend you edit your post to not include the name of the company. At the moment the only lawsuit I see is one directed squarely at you and the Toymods board for defamation.

maybe it is a bit bad naming them but i say thanks for warning me!
i was guna get a 4agze through them becoz they were so good to deal with. but since mentioning it to people i hear nothing but bad things about their workmanship.
i must be mistaken because i thought this type of thing is one of the reasons this forum is here.
if they mistreat a customer they deserve to be named.

maybe just edit the post to the facts without insults or name calling. i mean i would be hell pissed but you dont want them screwing you over for another thing. just keep to the facts. they did such and such and charged you X amount, and they did whatever to your car resulting in whatever damage. if i make sense.

I would change your post abit, especially if you are going to consider legal action. I would change to.

Something wishywashy like that , thats a personal opinion on the issue, so not as "defamatory". On the other hand your doing us all a favour by letting us know that really isn't a place worth going to to get work done, its a tough call, but if you want to take it further than you'll just have to be careful how you phrase stuff, even if what they did sux.
If you do want to get anything done, your going to need to have "written quotes" on all the work done, if you dont have that, then sadly you cant do anything.
2 options, talk to a solicitor and see what you can settle out of court(nasty letters from solicitors usually scare people into action), if that doesnt work and you've got the $$$ take them to court. Failing that, and I hate to admit it, write to ACA or some other Current Affairs show, they'll put the "dodgy business men ripping off the locals" spin on it, it'll either put them outa business or you'll get your money back.

this was gone over on an american forum
a used car company tried to sue a guy who recommended to the forum that they never buy from this place due to the treatment he received.
basically, the guy won the case, the used car people had to pay legal fees, and that message thread alone received in excess of 250 000 hits, so I'd imagine they lost more buisness because of the stink they kicked up.
and no, it is not defamatory if it's true. well, it's defamatory, but it's not "defamation" in the legal sense of the word

My suggestion is that you find out about your rights under Common Law...Ask someone in the know about "Letters of demand" etc.
While I find your comments useful, in that I won't be taking any of my vehicles to the mentioned place any time soon, I'd also suggest that taking action directed at the business, rather than ranting here, may be more productive...(Not that I dispute your right to have a rant! )

Seriously though, I'd be skeptical about taking my car anywhere to get stuff done except to have new tyres fitted as I can't do that myself.
Shame you got ripped, sounds like a common story. I'd definitely dith the workshop's name though or you'll end up with them suing you.

That's all well and good for the Yanks, but American legal precendent has no relevance here.
If I was a moderator I would have deleted this thread long ago... Australian forums have actually been permanently shut down as a result of similar activity. I know it's sounds wrong, but if a company wants to sue ToyMods the legal fees alone could be enough to sink the entire club - even if ToyMods is in the right. It ain't worth the risk IMO... but I'm not a moderator so it's not my decision.

We have had similar situations like this occur before and whilst we can understand a persons frustration with a business that they felt have treated them badly we cannot allow the club to allow comments that may be defamatory.
Certainly the business in question is entitled to a right of reply because there are always two sides to any story.
My suggestion in this case is for the person in question to put their complaints in writing to the company and allow them an opportunity to fix the problem or recompense him. This is the first step to any further action - you may be surprised at the result.
If this fails to produce a result then he should contact the NSW Department of Fair Trading who will take action on his behalf.
To protect Toymods the posts have been edited to remove the names. Please refrain from specifying names in such posts in the future.

if they gave you signed, written quotes for x amount of $$s then that should be all u should pay. I'd seriously see what your rights are about that.
When i got my car painted and rust cut out the guys quoted me $2300. It ended up costing $2965. I wasn't worried about this because initially they quoted me on the rust could see, and also each time they found new rust they would inform me. I would go in every 2 days to see the progress of the car.
the people were Bill Blocker's Paint and Panel located in Rockhampton QLD and i would recommend them to everyone. They are really great people to talk to and even though the price ended up being close to $3k. they were still the cheapest people in town.

It doesnt really matter if it is true.
If they sue Toymods for defamation, i could see the forums being taken down while the matter is resolved.
This happened over at Overclockers Aus.... the forums were down for about 4 months while the issue was resolved by lawyers.
James (who runs OCAU) ended up with a lawyer bill in the thousands.
