Hey guys,
A friend of mine got booked for doing 106km/h in a 100 zone.

I've suggested to him to write a letter stating that the ADR 18 allows a +/-10% leeway in the accuracy of the speedo.

Has anyone successfully tried this?

Am I right in assuming it's ADR 18?

Anyone got the wording from the ADR doco?

Any thoughts/suggestions/advice welcomed! Smile

In WA the police and courts say that if your speedo is out bad luck, you should have known it was out!!!

I suspect in NSW he'd have no chance since NSW is an even worse police state than here!!!

Hey Nark, pretty much what Blown86 said........

You know when you see peeps get really big chromies and then never bother to get their speedo recalibrated then it it is pretty much the same principal.

He has to cop it on the chin unfortunatly!!

He can try - Chances are it will have to go to court though. It's quite easy to write an appeal letter, but these are rejected just as easily..

If he says straight out: "The law says your speedo can be out by 10%, so therefore i'm allowed to do 10% more than the speed-limit" he will still cop it.

He may need to provide some proof that the speedo is out and is oging to be repaired?? (i dunno)

Just out of interest... Was he aware he was speeding and is looking for a way out of it, or is the speedo actually out?

He takes it to court, pleads not guilty, gets his solictor to ask the magistrate to delay the date based on him making "submissions" (written I think it's not fairs to appropriate people).

Paperwork will scare it off if he a clean skin, they'll give him a section ten in exchange for guilty plea.

Possibly 2 x court apprearance, will cost about $800 to $1k for the solicitor.

I've got off using these exact described methods (and a good solicitor).

One was a no seatbelt on double demerit long weekend.

I about to try another one soon.........we'll see how I go this time.

Sometimes your best to just cop the fine. But I'd really like to see everyone for one month elect court apprearance for any offence. The courts would fall apart.

Dont tell me you havent heard this Confused It was brought in at midnight a few weeks ago along with a lot of other stuff! Get cought doing 40ks over the limit and you loose your licence and get a $700 fine. From memory you 3km leeway at 100k speed limit Shocked

New speeding and driver licence penalties.
To improve road safety, tough new penalties for speeding and driver licence offences have been introduced in Queensland from 17 April 2003. Speeding plays a prominent role in contributing to the Queensland road toll so it is important that injuries and fatalaties caused by speeding are reduced. Drivers who fail to comply with their driver licence conditions also pose a road safety risk.

In addition to these penalty changes, drivers caught travelling at extremely dangerous speeds of more than 40 km/h over the speed limit will face losing their licence for six months.

in VIC coz the shit govt can't budget they are now introducing speed cameras in bloody cats eyes on the roads!

they're the same size apparently just 150mm deep or something.

Easy...stop voting for Labor Party. Hasn't anybody noticed that it has always been a Labour Party state government that has introduced fixed speed camera's across Australia?

NSW -> Fixed (but fortunately disclosed) speed camera's and soon to introduce state-wide (and unnecessary) 50km/hr zones in previous 60km/hr zones.

Victoria -> Fixed and undisclosed speed camera's and 50km/hr zones state-wide.

Queensland -> I'm not well-informed of the speeding regulations there, but I'm sure the Labor Beattie Government would have something up their sleeves.

I'm not here to advocate any political parties, just wanting to show the correlation between Labor governments and speed-camera's as such.

Nah, I reckon its just something to do with the water over east cos we have a Labor government too Razz

We don't have fixed speed cameras over here. We don't even have a great deal of mobile ones, I can go a whole week without seeing them.

I'm with Grega though, if you don't want to get caught for speeding, then don't do it in the first place.

It's just a matter of time Frank, the mob over here haven't been in power as long as Labor has in the East!!!

I was talking to a cop recently about the 50 Km/h limit here. He said that the traffic cops reckon it's BS and they've had to send sergeants out with the junior cops to make sure that they book people for doing 52 Km/h etc.

He was also saying that the authorities were pushing for 40 Km/h max in built up areas and a maximum open road limit of 80 Km/h!!!!!

I don't think he was aware that he was speeding. He's just unfortunate that he was in Victoria. The cops there are nazis over little breakages of the speed limit...

I got done in Vic for SFA over the limit (67 in a 60 zone from memory) in december last year (Was on the way to macca's and was hungry ok)

First I didn't pay the fine cause I figgered hey your in Victoria what are you going to do about it but they threatened to issue a warrant for my arrest (which I still ignored Rolling Eyes ) and then the courts sent me a letter with 7 days or they would cancel my licence (They really are bastards in Vic) Shocked

SO I I payed it and guess what..... Got my driving record the other day and the demerit points are not there Very Happy cause I have a NSW licence ! f#@kers just wanted my money.

In NSW 95% of coppers wouldn't have never given me a ticket ! God I hate Victoria. (Not the people, just the roads and the Nazi's who patrol them. )

The demerit point system is not linked nationally.

I think you'll find that you have lost those demerit points in Victoria...

Funny story, my friend was driving up here from Vic to start work.

He got busted for speeding big time and lost his licence in Victoria. The thing is, he can still drive in NSW and ACT 'coz he's got full points there! And since he's here now, he doesn't give a fuck! Laughing

I havnt seen a speed camera for about a month now Very Happy

But there was a HUGE blitz of them on the freeway a couple weekends ago or somthing, about 10 of the bastards...and a total of over 8500 fines handed out in 1 day on one road(freeway)!!!!
