qs : who do u talk to , to find out whether it is worth fighting against being 'at fault'?? a few people have said i would have a case but others say its a black and white ruling.
has anyone here had any luck with appealing?
is it worth it?
( i realise i havent said anything about the accident ,but at this point in time im sick of explaining it) ask me tommorow

All right im back, .... here we go....
this is very long winded .im a bit emotoinal on this one which u will tell and im not very good with words.
ill make some pics up. i stopped a an cross intersection (stop sign). began to cross the intersection , as i got to the otherside, my front bar cms from the line. i was hit by a car comming from the right, the car struck me at the rear drivers side. her right hand indicator would have been at the top rear of my rear drivers side wheel. i spun 90 into a telegraph pole on the corner to my left and bounced back in to the middle of the itersection, the other vehicle went through the fence behind the pole ( i still havent worked out how she got it there?). the other car was a 4 door hatch.
i do realise that being a stop sign it is my duty to check that there are no vehicles comming . but with the view at the intersection and without sticking my bonnet out nearly 2m onto the road there is no way i could have seen the other vehicle that far down the street. i saw her before she saw me and she was headed straight for me . i hit the gas but i didnt even get a chirp in before she hit me. she didnt brake or swerve. even my mum said there is no way she could have been paying attention .
i know for a fact that i could not have done anything any better to have prevented that accident ( except have not been there!)

Hmmmm. The fact that you were actually "in" the intersection when she hit isnt good. Were there any witnesses???

not visibly, altough a few people were there before i even got out of my car so they would have at least heard what was going on.

an 89 mz20 , white. engine had been rebuilt like 5mnths ago and 3 weeks ago i had the alarm installed.

If you could see far enough down the street then maybe she was speeding.She didn't do anything to prevent the accident so wasn't paying attention and the fact she hit the BACK of your car then you could (succesfully) argue that she was speeding or something to shift the blame.
Really you are both at fault in this particular incident,but thats only my opion.
