HELP! ~ GST from Items (Post) Paid Overseas!

Hey All,
I have ordered a huge part from America from a Toyota dealership.
To cut the story short, I had the part sent to Australia via United States Postal Service (Express) and they couldn't deliver it to the house as they needed to verify the item... They sent it to Sydney to get it opened to see what was inside the package... Now for me to get the item back from the USPS I am now requiring to pay for GST...
The thing is though, I paid for the item in America Using US Dollars and now I have to pay GST in Australia to get it to my door step
Is this legal?

GST on what exactly? The parts or the extra handling fees for the shipping to Sydney?
Legal is whatever the Government decides when you ask. Don't know if you pay GST on imported goods but they may slap some sort of import duty on it. But if something to do with it incurred a fee charged in Australia they you would have GST to pay, IF you paid for the fee, if they paid the fee then I think they should have paid the GST with it.
Who is trying to charge the GST? USPS or customs? And who is holding the item and what were they checking it for?

The Item was in Melbourne but since there was no phone number on the item, it was sent to Sydney for confirmation of what was declared inside the box where they opened the box. The USPS wants to charge GST for the item inside the box (Confirmed tomorrow if need to pay for it). But the thing is, I got my LSD from America there was no problems (Using surface mail) but this time I decided to get the Item here quicker as I needed it and I am coming up with all this drama...
The item is held I believe in the USPS headquaters in Sydney.
It's making me frustrated

think about if you were in america and you bought a lsd as a gift and sent it to your twin brother in aus
would he pay GST?
hell no
so whats the difference now?
they cant make you pay GST on something that wasnt PURCHASED in australia
i believe they may want you to pay for gst on the extra shipping in aus they had to do for verification

you have to clearly mark that the item is for a gift.
i just got shafted from customs for a camera i got sent here.. it was only $57 but still, i wish i had looked into it before hand.

Funny Enough I am a Twin Brother and I just got an LSD from America Refer to this URL TrueTrac LSD
But Hey! Everyone has to pay GST and they are doing their job... It cost me AUD$288.54 which isn't bad...
I paid for the Customs Duty of $51.25, Duty Paid 116.13 and GST total of 121.16 TOTAL of 288.54 for me to have the muffler...

Yes you will generally have to pay GST on imports as the importer just as people who export out of Australia don't have to charge GST - check out para 34-250 of your 2003 Master Tax Guide.
Irrespective of whether you have an ABN, the purpose of the GST is to make the end user bear the cost - hence, you will pay GST as an importer but as it's not for a business and you're not GST registered, you will not be able to claim a refund in the form of an input tax credit.
