date is set for 1st apr.
I get the prosecution info 25th march
Talked to the chamber magistrate while I was there, and he seemed to think I had a pretty good case (although he was careful not to advise me as to what I should do in terms of pleading)
basically, burden of proof is on the cops.
They have no visual witnesses to the accident, 1 guy who heard the accident, and the testimony of the officers on the scene.
I was in the car, and have photos to support the fact that the flat tyre caused the accident.
They need to prove either
a) I was drunk (I blew 0.0 on the breathaliser)
b) I was speeding (no visual witnessees of any kind)
c) Driving in a dangerous manner which caused the accident.
so on the 1st of april, think of me

$61 court costs, if I lose, + whatever fine the magistrate deems appropriate (usually stays at the same as on the ticket, in this case $176)
magistrate has the power to jack the fine up to $550 if he thinks I'm wasting the courts time or the cops can prove I was massively negligent, but otherwise it's just the $61 - police prosecutor, acting on behalf of the govt, can not make me pay the cost of his time (as would happen if you were challenging a council or other body - then you're up for around $300+ per hour in legal costs if you lose)

careful they maybe able to prove that u were speeding by ur skid pattern, thats if u left 1. As for the drink driving it sounds like u got that one beat. And neg driving well if u knew that the tyre was flat and u were driving too fast, this could be seen as neg driving.
I'm not a lawyer don't take my word on this. But good luck anyway.

they took no photos at the scene, and didn't examine the skid marks, so they have no proof there.
And, since the burden of proof is on them, they'll have a BLOODY hard time proving I knew the tyre was flat
I felt a lot better about my chances after talking to the chamber magistrate
I'll post more on the 25th, when I know what their argument is going to be

Take it from me (remember I've been there) 6 days to prep for it, request an adjournment and go see one of those "specialists" in traffic cases. Should be adjourned for a month, just to get an idea of what your are in for. Their first consult is usually free and most are no win no fee if you do go with them (not that it sounds like you need to) but they may sound out an idea you could run with.

When my mate had to goto court for neg driving, the prosecuting police didnt even show up because they had nothing..

As listed on my rego papers, my supra only had a 5m-e engine. Unfortunately, that car is now cubed, so the only proof rests on the rego papers.

and anyway on April Fools the only decent fool around this joint would be you  and of course when we think fool...we think Draven so definately our thoughts will be with you on that day... however, my brains getting rather sieve like and I may forget between now and then
