When i was delivering pizzas i bumped into a falcon at less than walking pace, i nudged the rear bumper. The damage looked very minor, with only a small scrape.
The owner claims it bent a bracket that holds the bumper, therefore the bumper will now not sit flush with the rest of the body on one side.
This all seems very suspect. he gave me a median of 2 quotes, it worked out to be $750

i asked him to get a second quote, but he went to his mate, a panel beater. He said that he would pay the extra 150 on top of the 750 that he wants me to pay.

When i questioned him about the exact model of the car(to try and get my own quote) he dismissed my query and said that he wants to get the matter sorted as soon as possible cause he wants to sell the car.

what are my options in this situation? do i have any say in where he takes the car?

yes and no ... IANAL but

do not agree or sign anything - when asked to comply with his demand, simply state you are seeking legal advice and cannot discuss the matter further. Do not get angy with the prickor accuse him of being a prick (even though he's behaving like one.

did he provide you with a written quote - it should have the VIN and rego number of the car on it, otherwise it's worthless butt-paper. If no details, then ignore the prick until you see a proper written quote (your own insurance would see three legit written quotes, why not you?).

you should be entitled to obtain an independant assessment of the damages - does your employer have come sort of insurance oversight for it's drivers? can you get them to assess the damage for you?

if the idiot keeps insisting for money without any proof of claim, go to the police claiming the guy is trying to defraud you (or if he's threatening to take or damage your car, affecting your job or enjoyments of life, then it's probably extortion).

but ... if you're seriously worried, see a real lawyer - you're probably able to see legal aid, and if you're a uni student, the the student union/association probably has free/cheap legal advice for members. If you're in a workers union, similar things are also available.

repairs can very quickly add up.

i got rear ended by a woman waiting for petrol, barely a nudge.

BUT

it dented the chrome bumper, and pushed it into the body, scraping paint off of the body around that area. ended up being about $700 repairs that they had to pay.

so on the other side of the story, as the one who got hit, i was getting very pissed off that they were refusing to take responsibility, and i think they only did so because they didn't expect the bill to be so big. that said, i provided written quotes from a couple of local places plus a police report so they had no chance.

get a written report, and not from their mates, but don't get aggresive or nasty about anything

thanks for the advice guys

the guy hasnt given me any written quotes yet just told me over the phone... now i remember that i actually pay a small fee out of my wages for insurance incase something like this happens while working..ill see my boss tomorrow and see what she can do to help me out
i am not a guy to get agressive or agro over something like this im the guy who is more likely to be walked over, thats why im here for help..it seems very suss that his mate has quoted it.
i take full responsibilite for what happened its just he is being very pushy and i thought id have more of a say in it...he is been a prick

ill let u guys know how it went if ur interested

He'll have to provide copies of at least 3 quotes if it occurred here in Queensland - there often tends to be a big disparity.

I had my AE86 rear bumper repaired but had to get quotes for a minor bump - ranged from as cheap as $400 to about $800 so $750 seems on the high end but is still a believable / realistic price.

i was driving my car...
my excess is $1200 or something so claiming it on 3rd party is out of the question...my work drivers insurance may be able to help tho so we will see...
i want the guy to take it to a car detailer i know so he can tell me if its done more than surface/ paint damage if the bloke co-operates or not is another story

i had an acco on friday and it was my fault so im in the same boat as you (except i wrote their car off and i aint got 3rd party haha).
say you want to go to their house and see it, if they say no, say see you later. you have the right to bring an independant valuer to asses the damages. after they get three WRITTEN quotes, offer them a cash settlement half of that. because its almost certain they are just trying to screw you for the money, they want the cash and wont fix it. or if worse comes to worse, let them fix it, take it to one of the panel beaters that they got the quote from (which ever is YOUR choice) and give them the money so the guy dont proffit from it. if they keep being an ass, stuff them around and say call my insurance company Confused

I rear ended a commodore...total bill recorded against my policy was $750 which was new bumper + mounts and a new front winscreen (I'm not sure how i damaged this driving into the boot!!)

Did you report it to the police? did he? if neither of you did, (i think) the only way he can pursue it in court would be for both of you to take a charge of failing to report an accident. would this be worth it from his POV, this may scare him off?

I would seriously talk to your insurance company (even though you won't want to lodge a claim) that way you will get ACCURATE information. I can't beleive some of the comments made here so far that people claim to be legal/correct etc...

I always thought you could get your insurance company to get an independant assessor to have a look at the damage (not too sure tho) Confused If you think the bloke is shifty...

If you work for Domino's like i used to...They've got 3rd party insurance on all bikes and cars, even if it's your car. The excess is like $500 tho.

i had a gemini i owned backed into, bent up the front drivers guard ... had it quoted at 1100!! yea i know WTF?!? but threre was a minor dint in the bonet from being pushed, same with the door and the wheels needed to be re-aligned etc etc... it all adds up.

to be the devils advocate here;

you hit him...
he needs to take time out of whatever it is that he likes to do to take his car in to be fixed because you hit him...
750 is getting off light. even a tap will bend the barckets, and lets face it if someone hit you you deserve to have the car restored to as it was before the crash.

having said that... what has happend to society? its a fukn car.
i ended up getting the gem fixed for $350 and told the nice lady to buy her kids something nice. she bought be a big bottle of burbourn to say thanks... it pays to be nice!!

with my one..... if i'd been hit in my old falcon, i wouldn't have worried at all, and tho i COULD have, wouln't have followed up and gotten cash which i woulda just kept.

but yes, on the devils advocate side, just be glad that people (like me again) forget to get a quote for a loan car while theirs is being fixed - this would also be in their rights to ask for. i should have done it, but forgot, cos i had to catch buses and walk for over a week while mine was fixed.

just have a proper look at the damage, if the damage is just on the bumper they're probably full of shit, if it's pushed anything else it's probably right

i would want my car back to original condition no doubt...well not the car i got now who cares ahah
im a young bloke only 18 this is my first accident involving another person and i will learn from this but i think he knows im young and is tryin to screw me over..OR he is telling the truth...

he is pretty pissed off cause 2 days before he just got it out of a shop after someone hitting and smashing up his front bumper...a lot worse than i have tho and he wants to sell it so its holding his sale back..tuff shit...things happen
you cant expect some decentcy from a stranger these days... im sure i wouldnt be a prick about it if it happened to me...all id want is my car in original condish...

i feel confident my work will be able to help me out and that way ill only have to pay the excess which is $400 or something and not have to (in his view) be a prick for not doing wat he wants...that way i dont have to pay more than i can afford or want to and he gets the car fixed...

Good point that was made before...you were in an accident that resulted in more then $500 worth of damage so he should have reported the incident. Most insurance companies will be reluctant to pay unless there is either a police report or a written confession (prob not the right word). So the most you should have to pay him is $500 which he could get through a court. But as I see it he wouldn't be able to get any more then that as he didn't report the accident.

But hey, if work insurance covers you just tell him to contact them. That way you dont have to deal with him anymore - and the insurance company will screw him anyway Smile

i can see how it can cost so much.. my bros a panelbeater.. i asked him to do studies of his own.. he said.. unless there replacing it with a BRAND NEW BUMPER there is no way in hell it should cost that much...
new brackets cost shit all and a small scratch is nothing this guy is being a complete c*nt, and should have not called u..
i wrote off my mums car.. when i ran up the ass of a honda legend that was sitting at a "GREEN LIGHT", it was green 20 metres before i got to the lights and i pulled out from behind a big murray bus to change lines and BANG!.. bitch called me up asking me to pay for her physio bills, that didn't even exist.. u gotta watch people they will lie through there ass.

guess what she was doing at the green lights.. on her mobile, as he was a flower courier.. he said he was stationary at the green light, because a young school kid was crossing the road, my ass its funny because it was a school holiday at the time! lying bitch!

according to the bloke it needs a new bumper and bracket so the price could be about right....my work excess is $1000 so thats not good to me...sucks big time...so all i can do now is get him to give me the 3 quotes (excluding the one from his mate) and ill pay the median and he can do wat he wants with the money.

Well there's some stupid advice. Don't ever believe anything you read on the internet Rolling Eyes

A claim of $750 would barely even be worth making, especially for a (I am making an assumption here based on the average age of Toymods punters) young driver. Add to that if f*cks your insurance history and it's a fantastic idea.

Believe me - I have delivered pizzas, been in accidents, and work for an insurance company. I know all the angles Razz That said, most pizza places offer their own insurance, in which case you should definitely claim off that (when I delivered pizzas all those years ago, it was $2/week deducted from every pay).

Otherwise, better off paying cash for a small claim like that. Sucks, but at least it'll teach you how to drive and you won't wreck your chances of insuring a half-decent car in future.

Any minor damage on a car is still going to cost a reasonable bit of money. $750, to me, is a reasonable amount for even the smallest mark on a car. The main cost, you will most likely find, is R&R (labour).

dude, dpnt rip anyone off - it is your fault after all .. get the written quotes, get YOUR own quote if possible and then pay up ... u would not want someone that hit you to fck u over ...

well its all finally over...i met up with his this afternoon and i had $700 agreed value after i looked at the quotes...i gave him the money got him to sign verifyin that he received the cash and that the matter is closed and we are all sweet.... so glad to get it off my back...the bloke didnt even shake my hand...i thought that was pretty rude...oh well
i would put the quotes up but i dunno how to post pics...

Dude, to me it sounded like you just got ripped off big time. As a Panel beater myself, if it needed a new bar it must of been one hell of a scratch. Depending on the model of Falcon, i would of said you want to see all the parts taken from the car. SIGN NOTHING BEFORE YOU SAW IT ALL. But it's all been done now so, there is not much you can do now. Just remember next time, they must get 3 quotes, ask which repairer they are using and if they are mates with the person don't use them. You do have a right to say who fixes the car, after all your paying for it. If they don't co operate in any way, simply walk away and seek legal advise.

oh well...
its all over now i had a look at the damage and it looked worse than the first time i saw it but it was night time so it was hard to see it had a couple dents..plus i looked over the quotes and it looked legit so i just paid the bloke and now i dont have to worry about it...
