Some dude hit me... he has no insurance

G'day guys,
I'm after a bit of advice... this is the first time i've ever been involved in an accident and the dude has no insurance... my baby is an ae71 4agze estimated i've put in about $7000 into this car... the whole back left is destroyed (hopefully i'll be able to post pics a bit later ) so what is the best option to do... he said that he'll pay for the damages so i guess i'll go to a smash repairer and get a quote but the car itself is only worth $400... can anyone suggest a reasonable course of action (preferably where i come out in front!!)????
Any help is greatly appreciated.

get 3 quotes to repair the car to its previous condition, ask him nicely to pay up, if he dosent and you have insurance speak to them thay maybe able to help you, and if you have full comp thay will chase him for the $$$ be very carefull about the excess tho some insurance companys will try and bone you for that even if he is at fault

You can certainly approach it that way. Get a couple of quotes for the repair of the vehicle, forward them to him, and offer settlement for a reasonable cash sum that is lower than the quotes received.
I actually just wrote a letter of demand in another thread, you may wish to modify it and send a copy along with the faxes. Makes it all a little bit more official, but given that it's going to a person & not an insurer, I would remove the references to legal action.

your car is engineered with the engine/mods right? is it insured with those mods? if no then you will most definately be wanting a cash settlement, but yeah i would do as suggested and offer him the option of paying you a cash settlement a bit less than the quotes, buy another car and transfer the stuff, atleast that way you got another spare car.

oh yes... it is most definately engineered and insured by shannons cause nobody else would touch me!! I was adding up the cost of it all to just get a new machine and transfer and it's gonna be pricey... also i was gonna take the opportunity to switch to a ta22/23. The dude who did my conversion originally is in brisbane and i'm in syd... so i'd have to factor in towing and engineering plus i can't expect the guy to do it for free... and if i switch to the celica i'll have to do a new brake upgrade (sorry evosti ) i think what i'm trying to say is SON OF A BITCH!!!

the 3 quotes thing is a good idea
unless you're under full comp your insurance company wont do shit for you...i have been in a similar situation
say hello to small claims court...ring legal aid and get them to send out an application form

the brake upgrade we did on your car can be transfered to a ta22 pretty easily. if your interested in giving it ago (transfering parts into a new car) you should be able to do alot of it yourself considering its allready in a car, all you gotta do is tag every wire and write a list of where they all connect to and take lots of photos with the digi cam and you can do it yourself. it will be pretty easy to transfer to a ta22, all you need is some custom mounts made up, thats the hardest part.

Go get a few quotes & see if its worth fixing.
If not try and agree on a price, probably about 3000-3500 and you get to keep the car.
Or just let insurance sort it out and they will prob just give you market value, about $3500 for a CSX AE71
