i was casually chatting to a mate about the nice shiniy alloy HKS biport carb maifold i had in my boot ( hint for sale hint ) we were going about 2 - 5 km/ph foot over the brake in my gf's sigma complete with 3 speed auto, just pulling up to a red light with a coupla cars in front of us, when we heard large brake lock up like 2 seconds we were like whats that, then, bang
my neck was whipping the tape from the tape deck popped out, ashtray flung open mirror was flipped the other way, i blacked out for a second and i woulda cut sick at him but i was in a bit of shock big hard hit! i got out and was like fuck taillight, his zl fairlane dunger was not worth fixing, on closer inspection, the sigma is a write off, the boot doesnt close, the roof is bowed as is the rear quarter, the rear door wont open and the back door has hit the front door all very gay, im thinking my gf might get $1500 in insurance, cool, then he says oh i have no insurance im like this is gonna be a fucking head ache, then the dumb cunt council worker said oh ill give u $100 ey i was like ummm no! total fuckhead no apology from him and my neck is killing i reported it and i have he detail im in for a lot of headfucks! all he said was something about his brakes, which is wrong because he was still going quite fast when he hit us people estimate 50 - 60km/ph and his brakes locked so obviously they worked he was just innatentive which i find hard to understand as there were quite a few cars stopped! fuck! to him, sorry for crap story

if u have his details, even if he doesnt have insurance, your gf's third party (she has that doesnt she?) can get u a payout for the sigma. im just not sure if itll work though, as u were driving and not her, u will have to check with her insurance company.

hey mate sorry to hear the bad news yes we know how you feel a good mate of mine had a Gemini (I know there not worth much but still) was crusin one day and this dickhead in this holden ute just pulls out of a drive way (on a straight stretch of road mind you) right in front of my mates gemmi he braked the brakes locked up and my mate served to the left but it was too late he hit the back hand corner of the HZ writting the gemini off dickhead in the ute jumps out and says "how fast were you doing I didn't see you" my mate was about to get out and flog the dickhead but couldn't as the door wouldn't open he got out via the window but I don't remember if he got an appologie or not as it happened a few years back he didn't get anything out of it though as dickhead denined the accident my mate had 2 wittness but seeing he was only gunna get $800 he didn't bother about it taking it to court but in your case old mateys fucked up if he said "it was the brakes that caused the accident" anyway because you still have to keep a car roadworthy and having faulty brakes means the cars unroadworthy what is he doing driving an unroadworthy car second of all he hit you from behind when you pulling up at the lights or stopped he can't say anything like your brake lights weren't working as he should of been slowing down for the red light if he saw it and he has to keep an eye on what you do as you were in front chass wanker for the money if you don't come to an agrement with him or if he doesn't pay up take him to court for it though I'm pretty sure the insurence company will chass him for it if your gf's cars covered but if not try to come to an agrement if he doesn't agree or doesn't pay up take him to court because he'll be fucked

pain felt lol ill keep all informed,
btw just got back from the doctors he said major neck spasms, and a fair strain one week to heal damn!! no real damage tho
no compo for me, still fucking hurts

it may be a sigma, but i ran every time and was my gf's only mods of transpaort total fuckhead! i think we can get $1500 + medical which is ok, and i can get my gf in a toyota...lol

lol yeah you's should be able to get $1500 for the sigma it might be old and it may be a sigma but it still a method of transprot to get from a to b that would be its market value at the moment (my opinion based on the ones for sale up here)plus medical should help yous out. glad to hear your ok theres some fuckheads on the road lost count how many near misses I've had because of some tools driving

It's hard to find a RWC car for much less than $1500. If it ran well and was reliable then it is most definitely worth that much.
When my bro was hit by a drunk woman (her insurance was then void) AAMI coughed up up to $3000 and then got their money of her. They were pretty cool about the whole thing and because you aren't asking for more than $3000 then you should be ok. Assuming other insurance companies are the same.

I think third party insurance should be law. Can't register a car without at least third party. Would be good IMHO.
And by what you said, his breaks where fine. His brain sounds like the thing that needs some servicing... that or his tyres.

you should be able to make a 3rd-party personal injury claim against the driver of the fairlane - all registered cars have 3rd party personal insurance -in qld its administered by <http://www.maic.qld.gov.au/>.
you should talk to your doctor and a lawyer about making a 3rd party claim. the DoT (or whatever passes for it in SA) web sites <http://www.mac.sa.gov.au/> and <http://www.transport.sa.gov.au/registrations/motor _vehicles/compulsory_third_party_insurance.asp> should have information about this.
You should be careful about this as you don't want to affect your g/f or your driver-mate's ability to get insurance.
it shouldn't matter if the dudes is poverty striken, as long as the car was registered, you can make a claim.
fwiw: My brother was a passaenger in a car hit by a toowoomba council git (are all council workers shit drivers?) and copped the door and arm-rest into his Kidney (only has one) plus whiplash. He got$3k compensation for pain, suffering and medical costs.

yeh i FINALLY got onto him today, his mobile was myteriously disconnected so i tracked his land line down, he has agreed to pay $1000 cash at $100 a fortnight, im not too keen on that and im not gonna make a compo claim at this stage, we will send him this thing from raa tomorrow and see what he says, but he keen to not do it through insurance......
neck still hurts lol, a claim ey sounds good lol,
