Summons and insurance Q Thu, 17 June 2004 16:33 Go to next message
Howdy boys,
i dunno whether youve read about my, um, indescretion in the war stories thingo, but i got a bill from powercore the other day..it was a temporary fix-$340 so im waiting for the full whack which should be great. I have extended third party on the written off car, so, i should be able to claim that. However, i will probably get charged for wreckless and speeding, so, my question is-is my insurance void seeing as tho i broke the law?

on that question, is there any way i can find out whether or not i will be charged? the copper said i prolly would be. its been 2.5 weeks since the incident.
thanks guys
word out

Read your policy..not usual to be declined unless you have breached specific written policy condition like alcohol/drugs or not licenced...etc

Generally insurance can't decline you for breaking the law, I mean most accidents involve breaking the law in some way (whether you get charged or not). Would make insurance quite pointless.
There are exceptions for driving an unroadworthy car (if it contributed to the accident and you should reasonably have known about the fault), drugs, alcohol and not having a licence.
Biggest problem will be how much it impacts on future insurance.

as said above

u should be covered ... reasons for no cover may include

driving when intoxicated
driving a stolen car which is not urs Smiley =
racing on a track
although it is to their disretion whether or not they cover u... i.e. if u had an unengineered car.. they may not

read ur policy it pretty much tells u what u need to know

my 18rg ra65 was illegal due to backwards engineering on the motor i could of got it blue plated but didnt in time as the car was on the road for about 3 weeks before the dude wrote it off

i still got a payout to cover the car though as i proceeded with intention to sue the driver of the other car which made his insurance deposit the full amount into my account instantly

They've got 12 months to the day of the offence to send you a summons, after the 12 months you don't have to worry. 2 mates have recieved their summons's 11 months or so after the offence happend.
