My mate had his car stolen and used in a ram raid recently and he has no comprehensive insurance. The police recovered the car but it was written off in the car chase.
Can he get compensation from the guys who stole it or will he have to sue for damages or something?

I don't really deal with this side of things, but at a guess you may have two options.

You may be able to sek gov't compensation as a victim of crime, or alternatively you may be able to sue the crooks... but in either case good luck.

I have also heard of a thing called "criminal compensation" , best people to ask would be a lawyer or the cops. once again good luck.

You didn't state where you're from ... in NSW, it is very hard to get cover for fire & theft if you go for only 3rd party property cover. You will really need to look at the policy to see if theft is included if it is comprehensive.

One can only assume that whilst you won't be liable for the damage caused, whether you can get anything back for the car will depend on how wide your policy is.

Did your mate read the fine line print? Rolling Eyes

I think if you can prove that the car was written off because of the car chase you could get compensation from the govt.

You could definately sue the crims but the judge may allow the crims to pay the debt off... i.e. 20 bucks a week or something until paid off.

My advice would be to go through victims of crime compensation - might get some money for it - *I think there is a limit of $5000 or something like that* but if that falls short you could always sue the crims for damages.....

When u go to court u have to pay a "victims of crime levy"
so i'd asumme it would be easy to get.
My mate got 10 grand cuz he was beaten up and lost a tooth they never found who did it.

But the goverment can be made to pay for it as it was the polices actions that caused the write off
